Mothers' lawyers mull citing IGP for contempt


Lawyers representing S Deepa and M Indira Gandhi are seriously considering citing Inspector-General of Police Khalid Abu Bakar for contempt of court.

This is over his suggestion that children involved in interfaith custody battles be placed in welfare homes as a middle path solution.

"We will have a concrete decision (on whether to make the application) next week.

"I will get instructions from my client next week for a firm decision," Deepa's solicitor Joanne Leong told Malaysiakini.

One of Indira's lawyers and Ipoh Barat MP M Kulasegaran, when contacted, also confirmed that they are seriously mulling over the matter.

This is despite the Ipoh High Court on Wednesday orderingthe police to find Indira's youngest daughter, Priyana Diksa, within 30 days, or for them to answer in court.

Indira's former husband, K Pathmanathan @ Mohd Ridhuan Abdullah, failed to comply with the order of the High Court in Ipoh to return Priyana, aged five, or known by her Muslim name as Ummu Habibah.

On Tuesday, Khalid suggested taking the middle path in resolving disputes where one of the spouse had converted to Islam by placing the affected children in a childcare centre where both parents could visit them.

This followed the civil High Court orders in both  the Deepa and Indira’s cases that both mothers , who remain Hindus, be given custody of the children.

Khalid had further said that police felt they were  "sandwiched" between two jurisdictions following separate civil High Court and Syariah Court orders.

Politicians from both sides of the divide and lawyers have said Khalid was bordering on contempt for the suggestion.

Late yesterday Prime Minister Najib Abdul Razak stepped in by suggesting that the parties take the disputes to the Federal Court.
