Minister unaware of claim that TPPA video infringed copyright



International Trade and Industries Minister Mustapa Mohamed today said he was unaware of claims that a video produced to promote awareness on copyright protection under the Trans-Pacific Partnership Agreement (TPPA) had allegedly infringed a local producer's copyright.
"I am unaware of the claims […] but any form of copyright infringement will not be condoned," he said during a press conference after a TPPA briefing session at Menara MITI in Kuala Lumpur.
On whether the 'TPPA Malaysia' Facebook page which had uploaded the video was managed by his ministry, Mustapa said he was unsure.
A ministry staff, however, later told Malaysiakini that it only has one official Facebook page named 'Ministry of International Trade and Industry, Malaysia'.
Film producer Zarul Albakri yesterday said the offending video had used excerpts of his 1986 movie 'Kembara Seniman Jalanan' without his permission.
The two-minute 30-second video on the TPPA starts out with text describing the movie starring M Nasir and Pyanhabib which is about artists suffering when their works are 'not respected, are stolen, plagiarised and their copyright not protected'.
It then plays a 20-second excerpt from Zarul's film showing M Nasir's character, Bujang, storming a press conference to punch a man who stole his song.
The 'TPPA Malaysia' Facebook page, when contacted, told Malaysiakini to refer to the Copyright Act's section on exceptions made for the use of copyrighted material.
TPPA Malaysia also commented on Pyanhabib's Facebook page, saying that the use of copyrighted material for non-commercial purposes was not an offence.
Section 9(4) of the Copyright Act states that published work can be used in research, private study, criticism, review or news if acknowledgement to the original work is made.
Section 9(5) says the government can reproduce published work if it was for public interest and of fair use. -Mkini
