MTUC urges govt to ensure MYAirline pay staff salary arrears

The government must ensure MYAirline Sdn Bhd clears all salary arrears owed to its staffers as promised in a meeting earlier, said the Malaysian Trades Union Congress (MTUC).

“MYAirline told its employees to work from home in October last year and promised to clear their wage arrears on Jan 31 during a meeting with the Subang Labour Department.

“As such, the Human Resources Ministry must intervene and update the status on the matter. Workers’ wellbeing must be prioritised,” said its secretary-general Kamarul Baharin Mansor in a statement.

In October last year, MYAirline abruptly suspended its operations, citing the company was experiencing "significant financial pressures" barely a year after its maiden flight.

"We deeply regret and apologise for having to make this decision as we understand the impact it will have on our loyal passengers, dedicated employees, and partners.

"Unfortunately, the constraints of time have left us with no alternative but to take this decision," MYAirline was reported as saying.

The sudden decision irked many, including Transport Minister Anthony Loke who said he was caught unawares by the decision.

“Mavcom (Malaysian Aviation Commission) was not even informed,” he was reported as saying.

Subsequently, Mavcom suspended the Air Service Licence of MYAirline on Nov 1.

Improve labour law

Meanwhile, Kamarul said MYAirline staffers cannot wait until a new investor comes in to rescue the airliner, calling it unreasonable.

He also said it was doubtful the airliner would get new investors soon as the company has stopped operations for five months.

“Paying salary is a basic matter when it comes to employment.

“Right now, its employees are having a tough time as they have not been paid since October and their employment status is also in limbo.

“Plus, we also have to consider that school sessions will resume next week and Ramadan is nearing,” he said.

On that note, Kamarul urged the government to improve laws pertaining to workers’ rights and strengthen provisions concerning salary payments, severance packages and others, particularly when a company folds.

“The laws must ensure companies act responsibly toward their workers, whereby the latter’s wellbeing is given top priority in case of bankruptcy.

“Right now, the provisions are not so effective, resulting in employers not paying their workers’ salaries while awaiting to be declared bankrupt,” he said. - Mkini
