I'm still MTUC president, meeting was illegal – Effendy

Malaysian Trades Union Congress’ Mohd Effendy Abdul Ghani, who was removed as president from the union, maintained that he is the president of the organisation.

“The meeting itself was illegal. How can you suspend an office bearer when there is a court order in place?” he asked when contacted by Malaysiakini.

Earlier, the MTUC announced that it had removed Effendy from his position during a meeting on Jan 19.

“As such, Effendy (above) is no longer authorised to use, represent or attend any events or meetings organised by the union.

“He is also barred from contesting any MTUC positions for the next two terms.

“Any statements issued by Effendy after this no longer represent MTUC,” its acting president Dauzkaply Nor Ghazali was reported as saying.

No major policy decisions

The court order referred to by Effendy points to the ruling made by the Shah Alam High Court on Sept 27, 2023.

According to a report by Free Malaysia Today, the stay order, among others, mentioned that its current office bearers cannot hold an election until the appeal is heard and decided.

The court also stated that MTUC can only hold meetings to manage day-to-day administrative activities, but cannot make any major policy decisions in the interim period.

“MTUC officials must notify parties who invite them for meetings and events of the High Court ruling, the pending appeal, as well as today’s decision to grant a stay,” the report stated.

‘How can they issue sacking orders?’

On that note, Effendy questioned how the office bearers, who are only allowed to hold meetings on managing day-to-day affairs for the time being, can issue sacking orders.

He also alleged that Kamarul Baharin Mansor, whose position as MTUC secretary-general is in dispute, was present during the meeting on Jan 19.

“The Registrar of Societies itself has clearly indicated that Kamarul is no longer MTUC secretary-general.

“Hence, any decision made by the committee is illegal,” he claimed.

Prior to the meeting on Jan 19, Effendy said he had written to the ROS in regard to the matter.

“And in the meeting, they said I was removed due to an alleged misconduct but what is the misconduct? Did they mention it?” he asked.

ROS urged to act

Effendy then urged the ROS to act on the matter to ensure MTUC’s good image does not get tarnished due to the dispute.

“And I maintain that I’m still MTUC president and the meeting was illegal,” he stressed.

Malaysiakini has reached out to Kamarul for comments.

It should be noted that this was not the first time the MTUC had attempted to remove Effendy but failed.

According to Sinar Harian, MTUC reinstated Effendy in August last year after realising they had been in breach of the court’s decision.

They also affirmed that Kamarul is no longer the union’s secretary-general.
