Tithe funds used to settle minister's legal fees

The Auditor-General Report 2010 has confirmed that RM63,650 was withdrawn from the Federal Territory Islamic Council zakat (tithe) fund to settle advance legal costs incurred by Minister in the Prime Minister's Department Jamil Khir Bahrom and two others.

NONEThe legal costs had been incurred when opposition leader Anwar Ibrahim named Jamil, Federal Territory Islamic Department director, Che Mat Che Ali and its chief prosecutor Shamsuddin Hussain, as respondents in the politician's qazaf application.
However, the report states the sum was returned to the tithe fund after the council obtained a RM700,000 grant in June 2010, as its general resources allocation from the government.

"Che Mat had approved the withdrawal from the tithe fund twice that is in January and April 2010 to the amount of RM31,500 and RM32,150 respectively following the court case. The allocation come from zakat as advance and it has been repaid," according to the report.

"The council has appointed the firm of Zainul Rijal Talha and Amir, and as the case involves office bearers from the council."

The auditor-general's report was made available in response to questions posed to the Public Accounts Committee chaired by Azmi Khalid, by three MPs Saifuddin Nasution Ismail (Machang), Kamaruddin Jaafar (Tumpat) and Nurul Izzah Anwar (Lembah Pantai).

The reply by Azmi who appended the report from the auditor-general was dated Dec 14 which Nurul Izzah posted on her blog.

The auditor-general had found that the transaction was recorded in the council's journal with the account closed in 2010. The advance and repayment had been verified by the audit, the report states.
