Activist Hishamuddin Rais to SUE Najib Razak over Sedition Act speech

We refer to the above matter in which we act for Encik Hishamuddin Bin Md Rais,

We are instructed that you in your capacity as president of the political party known as UMNO, gave a speech at its Annual General Assembly on 27" November 2014.

We are further instructed that during this speech you had screened or caused to be screened a video clip depicting our client.

The video clip was screened in the context of your announcement that the Sedition Act 1948 will not be repealed.

In the video clip, our client was depicted as being guilty of committing the offence of sedition (hasut) under the Sedition Act 1948. The clip further demonized and portrayed our client as a serial sedition offender.

Sub-judice

As you are fully aware, our client is facing a charge under the Sedition Act 1948 which is now pending before the Kuala Lumpur Criminal Sessions Court.

We are instructed that your actions/ words above create a substantial and genuine risk of prejudicing the course of the criminal proceeding against our client, and that the screening the clip andor your speech is sub-judice and in contempt of court.

You have further created an atmosphere of hate and prejudice against our client.

We are instructed that your speech (including the video clip depicting our client) was broadcast over television and widely disseminated in print and online media.

At all material times, you also hold the position of Prime Minister of Malaysia, being the highest executive position in the county.

We are now instructed to put you on NOTICEwhich we hereby do, that you are not to screen, display, distribute or disseminate the said video clip again at the UMNO Annual General Meeting which continues or upon any other occasion or to make similar allegations against our client whilst the case is pending in court.

Should you fail to comply with the above, we have instruction to commence committal proceeding against you.

Meanwhile our client reserves his right to take necessary steps, including but not limited to committal proceedings with regards the screening of the video clip and or your speech in relation to and adverse to our client on 27the November 2014.
