Convicted Johor driver's case to be heard at appeals court Monday

 


Clerk Sam Ke Ting, who was recently sentenced to six years’ jail and RM6,000 fine for reckless driving that killed eight teen cyclists in Johor, appears to have a hearing at the Court of Appeal next Monday (April 18), according to court filings.

The hearing is most likely to be her application for a stay of execution, pending the appeal against her conviction and sentencing.

However, her lawyer Muhammad Faizal Mokhtar has declined to answer messages and calls on whether the hearing on Monday is set for Sam’s application for a stay of execution.

On April 13, the Johor Bahru High Court overturned Sam’s acquittal from a reckless driving charge.

Judge Abu Bakar Katar said the defence failed to raise reasonable doubt against the prosecution’s case, which had proved the essence of the offence.

As such, Sam was sentenced to six years in prison and was also fined RM6,000. Failure to pay the fine will result in additional six-month imprisonment.

The judge had also rejected the defence’s application for a stay of execution and ordered them to secure leave to appeal from the Court of Appeal first.

Sam was also disqualified from driving for three years, effective immediately after she completes her prison sentence.

On Feb 18, 2017, eight cycling youths died, two others were critically injured and six more were slightly injured when the car Sam was driving rammed into them in the 3am incident.

Those who were killed in the incident were Mohamad Azrie Danish Zulkefli, 14; Muhamad Shahrul Izzwan Azzuraimie, 14; Muhammad Firdauz Danish Mohd Azhar, 16; Fauzan Halmijan, 12; Mohamad Azhar Amir, 16; Muhammad Harith Iskandar Abdullah, 14; Muhammad Shahrul Nizam Marudin, 14 and Haizad Kasrin, 16.

As the reckless driving case initially originated at the Magistrate’s Court rather than the Sessions Court, she needed to obtain leave from the Court of Appeal before she could proceed with the appeal. - Mkini
