Residents can bring case to compel production of PJD Link documents

 

The controversial Petaling Jaya dispersal link project, which was approved in September 2020, has met with multiple protests by residents.

KUALA LUMPUR: The High Court here has granted leave for four Petaling Jaya residents to pursue a legal challenge to obtain documents relating to the proposed PJ Dispersal (PJD) link project.

Lawyer Lim Wei Jiet said Justice Amarjeet Singh allowed the application during proceedings in chambers today.

The suit is now fixed for case management on July 24.

Last month, residents T Chakaravarthi, Kum Koo Ji, S Saktiseelan and Loke Yin Pong filed a bid to commence judicial review proceedings against the state and federal governments over the controversial project.

They named the director-general of town and country planning as well as the director of the Selangor town and country planning department as respondents.

The four want the court to compel the government to produce the Social Impact Assessment (SIA), Environmental Impact Assessment (EIA) and Traffic Impact Assessment (TIA) reports submitted by developer PJD Link (M) Sdn Bhd.

They also want the government to produce the minutes of a focus group discussion, the detailed design of the project, as well as the concession agreement between PJD Link and the government.

They are also seeking a declaration that parts of the Official Secrets Act 1972 are unconstitutional as they breach the residents’ right to information under Article 10(1)(a) of the Federal Constitution.

The Selangor government had in September 2020 approved in principle the PJD Link project, subject to receipt of these EIA, SIA and TIA reports. - FMT
