Brief grounds for 'basikal lajak' case judgment

 


On Wednesday (April 13), the Johor Bahru High Court sentenced 27-year-old clerk Sam Ke Ting to six years in prison and a fine of RM6,000.

Judge Abu Bakar Katar also rejected the defence’s application for a stay of execution, ordering them to secure leave to appeal from the Court of Appeal first.

This was after her acquittal at the Magistrate’s Court was overturned. She was charged with reckless driving which caused the death of eight teenagers who were cycling on basikal lajak (illegally modified bicycles) in the 2017 incident.

On Feb 18, 2017, eight youths died, two were critically injured, and six were slightly injured when the car Sam was driving rammed into them at around 3am.

Those who were killed in the incident were Mohamed Azrie Danish Zulkefli, 14; Muhamad Shahrul Izzwan Azzuraimie, 14; Muhammad Firdauz Danish Mohd Azhar, 16; Fauzan Halmijan, 13; Mohamad Azhar Amir, 16; Muhammad Harith Iskandar Abdullah, 14; Muhammad Shahrul Nizam Marudin, 14; and Haizad Kasrin, 16.

Back in 2019, magistrate Siti Hajar Ali acquitted Sam without calling her to the stand after finding the prosecution failed to prove a prima facie case.

Siti Hajar acquitted Sam again in 2021 when the High Court ordered Sam to enter her defence.
