The police will release writer Uthaya Sankar SB – who is alleged to have insulted Prophet Muhammad – after they failed to obtain a remand order against him today.
Uthaya’s (above) lawyer Rajsurian Pillai said magistrate Sharifah Muhaymin Abd Khalid rejected the police’s application for a four-day remand.
The remand application was heard at the Dang Wangi police district headquarters this morning, where Uthaya was detained.
“The police tried to get a remand order for four days, but I objected and the magistrate only gave them one day (remand) and so (Uthaya) will be released this evening at 6pm,” Rajsurian told Malaysiakini.
The police had yesterday arrested Uthaya at his house in Shah Alam to assist in an investigation into a post on his social media linking the practice of polygamy with Prophet Muhammad.
The writer had taken to social media on April 8 to lambast actor Iman Zulkarnain, who was polygamous.
In his post, he was referring to a Malaysiakini report on April 6, in which Iman said he did not want to continue living a polygamous lifestyle.
Police Criminal Investigation Department director Abd Jalil Hassan had previously said Uthaya was being investigated under Section 298A of the Penal Code, a law that stipulates offences related to creating disharmony and disunity, and Section 233 of the Communications and Multimedia Act 1998 for improper use of communications network. - Mkini
