The Kota Bharu Election Court has struck out BN's election petition for Gua Musang, following the firing of the legal team of Mohd Azmi Mahmood, a representative of BN candidate Tengku Razaleigh Hamzah.
Lawyer Yusfarizal Yussoff, who represented Perikatan Nasional’s Gua Musang MP Mohd Azizi Abu Naim, confirmed with Malaysiakini what transpired before High Court judge Amarjeet Singh earlier today.
"The Gua Musang petition was struck out as Ku Li (meaning his election representative Azmi, who is the petitioner) fired all his lawyers, including (Muhammad) Shafee Abdullah and Hafarizam (Harun).
"The court was shown the letter (from Azmi to law firm Hafarizam Wan & Aisha Mubarak dated Sept 4 over the sacking), with a copy sent to the respondent's (Azizi’s) lawyers this morning," he said.
According to a copy of the letter sighted by Malaysiakini, Azmi confirmed the sacking of the lawyers previously acting in the Gua Musang election petition.
Azmi said with the sacking, the said lawyers would not have the right to act for him in the said petition.
Malaysiakini is attempting to reach out to Hafarizam and Shafee over the matter.
It was reported that Azmi filed the petition to nullify the 15th general election results for the Gua Musang parliamentary seat which was won by Azizi, who defeated Tengku Razaleigh by a majority of 1,826 votes.
Earlier on Feb 26, the Kota Bahru High Court struck out Azmi’s petition, ruling that the petition was filed out of the permitted time frame of 28 days as set out under the Election Offences Act.
However, on June 19, the Federal Court allowed Azmi's appeal and ordered the petition be subjected to full trial by the Election Court.
Besides Yusfarizal, respondent Azizi was also represented by counsel Takiyuddin Hassan and Mohd Fauzi Che Abu. - Mkini
