MORE KANGAROO COURT? Anthony Loke's defamation suit against 2 MCA leaders DISMISSED
SEREMBAN - The High Court here dismissed a RM5 million defamation suit brought by Negri Sembilan DAP chief Anthony Loke Siew Fook against two MCA officials for alleged defamation on February last year.
Judge Datin Zabariah Mohd Yusof ruled out that Loke, had failed to prove his case on the document alleged to be the defamatory article.
In his statement of claim, Loke had named state MCA secretary Datuk Lim Fui Ming and his deputy Jason Lee Kee Chong as defendants for allegedly uttering defamatory remarks in an article published in the Guang Ming Chinese daily on Feb 24, 2012.
He claimed that the two had defamed him by accusing the plaintiff of not having a heart and being selfish for not helping his elder brother who was being burdened with loans at that time.
He had demanded RM3 million for general damages and RM2 million for lesson damages and an order to prevent the defendants to repeat the claims.
Hefty costs
However Zabariah said although the contents of the article were defamatory to Loke, the plaintiff had failed to prove that the remarks were made by the duo.
She also dismissed the plaintiff's case that the defendants conspired to defame Loke since they had no knowledge of the article.
Zabariah also ordered Loke, who is state opposition chief and Seremban member of parliament to pay RM35,000 in costs to each defendants.
Lim and Jason were represented by Ganesalingam, Haresh Mahadevan and Ramzani Idris while Loke was represented by KF Wong. - NST
