Former Umno Batu Kawan vice-chief Datuk Seri Khairuddin Abu Hassan will challenge his 28-day detention under the Security Offences (Special Measures) Act (Sosma) 2012, said his lawyer Muhammad Rafique Rashid Ali.
The lawyer said he received this instruction today after meeting Khairuddin who was being held at the Dang Wangi police headquarters until October 21.
"We have specific instructions from Khairuddin, our client, to file for an order from court declaring his detention illegal," Rafique told reporters outside the police station.
Rafique, who is the appointed spokesperson for the six lawyers representing Khairuddin, said his client was being detained for investigations under Section 124K and Section 124L of the Penal Code.
Section 124K deals with sabotage while 124L is over attempts to sabotage the state.
Rafique, however, did not say when the application would be filed.
Another lawyer, Fahmi Abdul Moin, said they were satisfied with the way police were treating their client.
"The police have been accommodating and have allowed his wife, Datin Umie Aida, to visit him. We are grateful for that," he added.
Khairuddin was detained as his move to use foreign enforcement agencies to press Putrajaya over the 1MDB issue could be deemed as an act of sabotage against the country.
Khairuddin first lodged a police report against the state owned 1MDB in December last year, and was subsequently sacked from Umno after being declared a bankrupt.
He recently lodged reports with authorities in Hong Kong, Switzerland, France and the United Kingdom against the troubled firm, of which Prime Minister Datuk Seri Najib Razak is advisory board chairman.
