A police inspector will face nine charges tomorrow over the alleged rape of two Mongolian nationals.
The police officer will face six charges under Section 376 (2)(f) of the Penal Code for allegedly raping the first victim and two charges under the same law for allegedly raping the second victim.
According to this law, the rape was conducted with consent but the consent "is obtained by using (the accused's) position of authority over her or because of professional relationship or other relationship of trust in relation to her".
The penalty for violating this law is a jail term of between 10 to 30 years and whipping.
Additionally, he will be charged under Section 354 of the Penal Code for using criminal force against the first victim with the intent to outrage modesty.
The maximum penalty under this law is a maximum 10-year jail term, a fine, whipping or any of the two such punishments.
Petaling Jaya district police chief Nik Ezanee Mohd Faisal said the accused would be charged at the Petaling Jaya sessions court tomorrow.
"I said before we will go all out on the investigation and we did," said Nik Ezanee.
Malaysiakini is withholding the name of the police personnel until he is formally charged.
He was alleged to have detained the two victims on April 10 at a checkpoint and raped them at a hotel.
Earlier today, he was charged under Section 13(f) of the Anti-Trafficking in Persons and Anti-Smuggling of Migrants Act 2007 for allegedly abusing his power for trafficking people with the purpose of exploitation.
The penalty for breaking this law is a jail term of between three to 20 years and a fine. - Mkini
