'Promises breached' - Azmin seeks to strike out constituents' suit

 


International Trade and Industry Minister Azmin Ali will be filing an application to strike out a suit brought against him by 10 Gombak voters.

The Gombak MP's lawyer Nizamuddin Abdul Hamid confirmed that the  application would be filed before Feb 16, which is the next case management date of the main suit.

"We will file an application under Order 18 of the Rules of Court 2012 to strike out the suit.

"The striking-out would be over (the alleged reasons) that the suit has no reasonable cause of action or in the alternative that the suit is scandalous, vexatious and frivolous.

"Ultimately, we believe that the whole statement of claim (of the suit) is an abuse of the court process," he added.

Nizammuddin spoke to Malaysiakini after case management of the suit before the Kuala Lumpur High Court today.

It was reported that the 10 Gombak constituents filed the suit against Azmin over an alleged breach of purported promises he made in the run-up to the 14th general election.

According to a copy of the suit, the 10 are seeking a total of nine court declarations including how their elected representative owed them a fiduciary duty and had allegedly breached that duty.

A fiduciary duty typically refers to a relationship between a trustee and a beneficiary.

The plaintiffs further alleged that Azmin had violated their trust by working with BN in the "Sheraton Move" political coup to cause the collapse of the Pakatan Harapan federal government despite he himself campaigning and winning his seat on a PKR/Harapan ticket.

Azmin, who was the former deputy president of PKR, is now a Bersatu supreme council member. - Mkini
