Adly not appealing in legal challenge against Malacca state dissolution

Former Malacca chief minister Adly Zahari will not appeal against a court dismissal of his legal challenge against the decision to dissolve the state assembly.

Lawyer Razlan Hadri this afternoon confirmed that his client has decided not to appeal to the Court of Appeal against the Kuala Lumpur High Court decision delivered on Nov 10.

“Adly (is) not filing any appeal,” the counsel told Malaysiakini.

On Nov 10, judge Noorin Badaruddin dismissed Adly’s application for leave to commence a judicial review, ruling that the decision-making process to dissolve the Malacca state assembly last month is not a matter that can be challenged in court.

Following the dissolution of the Malacca state assembly on Oct 4, the Election Commission (EC) then fixed Nov 20 for the state polls.

Following the state election, Adly, who is Malacca Pakatan Harapan chief, officially retained his Bukit Katil seat with a 1,057-vote majority.

On Oct 22, Adly filed the judicial review leave application to invalidate the dissolution of the state assembly.

Newly elected Malacca chief minister Sulaiman Md Ali, former state assembly speaker Ab Rauf Yusoh, the EC and Malacca governor Mohd Ali Rustam were named as the first, second, third and fourth respondents in the legal action.

Earlier on Oct 4, four assemblypersons led by Umno's then Sungai Udang representative Idris Haron announced their decision to withdraw support for then chief minister Sulaiman.

The other three were Nor Azman Hassan, Noor Effandi Ahmad and Norhizam Hassan Baktee. The trio were then assemblypersons for Pantai Kundor, Telok Mas and Pengkalan Batu, respectively.

Following the collapse of the state's Perikatan Nasional administration, Ali decided to dissolve the state assembly, paving the way for a state election on Nov 20.

The judicial review was targeting the validity of Sulaiman’s advice to Ali for the state assembly to be dissolved. - Mkini
