  • last year 43 year old mother jailed 14 mths for stealing 2 packets Milo
  • both cases symptomatic of  much bigger problem
  • Malaysia’s two-tier system of justice

  • soft approach towards elite
  • hardline for everyday people
  • Selective prosecution rampant
  • little mercy within AG's chambers towards poor

  • trial of N---b epitome of this two-tier legal system
  • N---b received VVIP treatment
  • granted delays for most trivial of reasons
  • passport returned so he could visit Singapore
  • privilege granted to ex PM N---b
  • petty criminals given no leeway 
  • no stay of execution of sentences
  • highlights one set of laws for elite, another for rest

  • Malaysia has a long history of selective prosecutions 
  • ex PM Muhyiddin Yassin victim of same selective prosecution 
  • high-profile politicians on govt side are seeing acquittals 

  • appearance of politics through charging and trial process 
  • few Msians looking at this issue in an objective manner 
  • minds clouded with their politics 
  • destroying integrity of Malaysia’s legal system

  • Malaysian have lost sense of right and wrong 
  • civil service finding out cover up means ‘crime does pay’
  • starts with cheating on time-cards and expense reports
  • odds are they will get away with it
  • if caught things will be covered up
  • This culture carrying on unchecked

  • stealing RM 80 worth of Milo gets 14 months jail  
  • others steal hundreds of thousands and get away with it
  • Malaysian civil service shields their own

  • DNAA indicates justice is not blind in M'ysia 
  • there are long-term consequences
  • can someone really get a fair trial in this two-tier system?

  • citizens should be demanding reforms to system
  • public prosecutor should be independent from AG
  • Political considerations must be taken away 
  • some mechanism to assist poor face court hearing
  • legal system must be compassionate towards poor
  • legal system in a mess due to political interference 
  • and two-tier culture by those working within it
  • Preventing future injustices is more important
  • DNAA is  symptom of much bigger problem.

My Comments :

Personally I still have high regard for the judiciary (although there have been psychos). 
The judges in our Judicial System seem to hold their own.

The problem is elsewhere. The political interference begins elsewhere. I agree with what Prof Murray Hunter has written above. The most disgusting and flagrant interference began with that ex PM firing the AG overnite, after the leak in social media that an arrest warrant had been prepared by the AG against him. 

Then he put in his own handpicked shrimp who caused more damage to the AG Chambers. This trend seems to be continuing. 

May I draw your attention to the following statement by Murray Hunter:

"citizens should be demanding reforms to system"

I would like to address this to the orang Islam in the country. The Muslims. Especially those who are "going to heaven".

Do you really believe in Islam? Are you really Muslims? More importantly what exactly do you understand when you say 'I am a Muslim?"

Is 'close one eye' part of your religion?

There was a controversy about that  one (Muslim) judge who did not refute or reject a witness saying 'a Muslim cannot tell lies'. The witness' false statement was admitted.

Would that be considered part of your understanding of  "Islam"? That a Muslim cannot tell lies? Because if you do then that is also part of the reason for your indifference towards the injustices described in the article above.

Here is my observation.

If a Muslim stumbles upon an argument between a Muslim and a non Muslim the Muslim will immediately take the side of the Muslim in the argument. But what about the truth of the matter? Dont you want to know what really happened?

If a Muslim stumbles upon a war between a Muslim country and a non Muslim country he will immediately support the Muslim country.   What about right and wrong? What about who started the war in the first place?

To the Muslims who do not disagree with my observation (which I have seen a hundred times) and are ok with this type of behaviour then what is the difference between you and that false belief that  'a Muslim cannot tell lies'?

And once you believe in falsehoods like 'a Muslim cannot tell lies' it is an easy slip and slid to your damnation. Now you can replace the word 'Muslim' with other words like 'my race' (since Malaysia is so damned racial and racist), my party, my language, my fellow Civil Servants, the people who look like me, talk like me, eat like me, smell like me etc.

Here is a verse from the Quran, Surah 4:135 that you may like to read. Or which you might like to forget (its your choice), immediately after reading it.


 ۞ يَـٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوا۟ كُونُوا۟ قَوَّٰمِينَ بِٱلْقِسْطِ شُهَدَآءَ لِلَّهِ وَلَوْ عَلَىٰٓ أَنفُسِكُمْ أَوِ ٱلْوَٰلِدَيْنِ وَٱلْأَقْرَبِينَ ۚ إِن يَكُنْ غَنِيًّا أَوْ فَقِيرًۭا فَٱللَّهُ أَوْلَىٰ بِهِمَا ۖ فَلَا تَتَّبِعُوا۟ ٱلْهَوَىٰٓ أَن تَعْدِلُوا۟ ۚ وَإِن تَلْوُۥٓا۟ أَوْ تُعْرِضُوا۟ فَإِنَّ ٱللَّهَ كَانَ بِمَا تَعْمَلُونَ خَبِيرًۭا

O you who believe, stand up for justice - (fair) witnesses for Allah, even against your own selves or both parents, and the kinsmen. The rich or poor, Allah is better caretaker of both. So do not follow desires, lest you should swerve from justice. If you twist or avoid (the evidence), then, Allah is all-aware of what you do - Surah 4:135.

Please remember this important maxim. (A maxim is a general truth). The Quran tells us to do something or to not do something because that is indeed the correct thing to do.

Murder is wrong not just because the Quran says so. The Quran says so because indeed murder is a terrible wrong. This is a universal truth.

Similarly we dont stand up for justice and tell the truth just because the Quran says so. The Quran says so because that is indeed a universal truth. It is the right thing to do.

The Muslims in this country, especially the Malays who make up the majority of Muslims must stand up and speak against the injustices in our legal system. Especially the Attorney General's prosecution of their tasks and responsibilities.

You did not speak up before. A community that is just timid and toes the line. Hence the country has reached disastrous levels today.

Better late than never. Start speaking up now. More importantly stand up now and be counted.
