KUALA LUMPUR: The High Court will hear an application to transfer the criminal breach of trust case from the Sessions Court involving former prime minister Datuk Seri Najib Tun Razak and former Treasury secretary-general Tan Sri Dr Mohd Irwan Serigar Abdullah on Dec 7.
The date was fixed by deputy registrar Nurliana Ismail in chambers here on Friday (Nov 30).
The application will be heard by Judicial Commissioner Rozana Ali Yusoff.
DPP Mohd Izhanudin Alias told the media that Najib had applied for the case to be transferred to the High Court.
“We have no objection to the case being transferred to the High Court. Mohd Irwan did not make any application but he too had no objection for the transfer,” he said.
DPP Mohd Izhanudin added that the case would be tried together as the two accused were jointly charged.
Lawyers Rahmat Hazlan and Datuk K. Kumaraendran appeared for Najib and Mohd Irwan respectively during the proceeding.
On Oct 25, Najib and Mohd Irwan claimed trial to six charges of CBT involving RM6.6bil at the Sessions Court.
They were jointly charged with six counts of CBT under Section 409 of the Penal Code.
The first two charges were activities said to have been committed on Dec 21, 2016 involving RM1.2bil and RM655mil.
In the third charge, Najib and Mohd Irwan allegedly committed CBT on Aug 3, 2017 over RM220mil, which was an allocation for administration expenses for the Kuala Lumpur International Airport.
The fourth charge involves an amount of RM1.3bil allocation for subsidy and cash aids, allegedly committed on Aug 10, 2017.
The fifth and sixth charges were for committing CBT on Aug 23 and Dec 18 the same year involving an amount of RMB1.95bil (RM1.261bil) and RM2bil respectively.- Star
