Warisan has urged Sungai Sibuga assemblyperson Musa Aman to "move on" following the Court of Appeal's dismissal of the latter's suit which challenged the Sabah governor's power to dissolve the state assembly.
In a statement today, the party's permanent chairperson Liew Vui Keong (above), a former lawyer, said the matter could not be challenged in court as the governor had the absolute discretion to do so.
"Musa nevertheless continued to challenge this power of our governor in pure fear of facing Sabahans at the polls later this month. But justice has prevailed," said Liew.
Now that the High Court and Court of Appeal had ruled on the matter, Liew urged Musa to respect the decision and instead prepare for elections.
"Let us allow Sabahans themselves to freely and democratically elect a state government of their choice and to exercise their consent to be governed.
"See you at the polls," said Liew.
Musa and 32 other state lawmakers had sought a judicial review against Sabah governor Juhar Mahiruddin's decision to dissolve the state assembly in July.
However, the High Court did not grant leave for the matter on grounds that it was non-justiciable.
This ruling was reaffirmed today by the Court of Appeal.
Musa and the 32 others are expected to bring the matter to the Federal Court.
On July 30, Musa publicly claimed that he had the numbers to form a new government.
However, Juhar dissolved the state assembly, on the advice of the Chief Minister Mohd Shafie Apdal, before Musa could approach the palace. - Mkini
