Family seeks to overturn misadventure ruling in Nora Anne's death

 


The family of Nora Anne Quoirin will file a legal bid to reverse the Coroner Court ruling that the Irish-French teenager’s death was due to misadventure.

The family’s counsel in Malaysia, Louise Azmi, today confirmed that they have informed her of their instruction to file the revision application.

“Yes,” Louise said when asked by Malaysiakini on whether the family is seeking to overturn the Seremban Coroner Court’s ruling.

The lawyer also confirmed that the legal team is making preparation to file the revision bid at the Seremban High Court.

Yesterday, BBC News quoted Nora Anne’s mother Meabh Jaseprin Quoirin as saying that “the inquest is a battle that we must continue in Nora Anne’s name”.

The United Kingdom-based news broadcaster reported that the family would “appeal to the Malaysian High Court to re-examine the evidence and record an open verdict instead”.

The video interview also reported that Nora Anne’s parents believe that the deceased was abducted.

On Jan 4, the Seremban Coroner Court ruled that the teenager’s death was due to misadventure.

Coroner Maimoonah Aid had ruled that no third parties were involved in Nora Anne's death in August 2019, after she went missing from the Dusun resort in Seremban, Negeri Sembilan. 

“After hearing all the relevant evidence, I rule that there was no one involved in the death of Nora Anne.

“It is more probable that she died by misadventure, that is, when she had gone out of the Sora House (at Dusun Resort) on her own and subsequently got lost in the abandoned palm oil plantation,” Maimoonah said.

“For me to speculate and presume of her action and involvement of a third party without any proved facts would be a breach of my duty.

“The inquiry is hereby closed,” she added.

Streamed live

A total of 47 witnesses, including the teenager's parents, Meabh Jaseprine and Sebastien Quoirin, gave testimony during the inquest proceedings which began on Aug 24, last year.

The proceedings were also streamed live online through the Malaysian judiciary’s official portal via YouTube and Facebook, and conducted in Bahasa Malaysia and English.

Nora Anne, 15, went missing on Aug 4, 2019, a day after she and her family arrived in Malaysia for a two-week vacation at a resort in Pantai near Seremban.

Following a massive search, her body was discovered near a creek in a ravine, located about 2.5km from the resort where she and her family stayed, on Aug 13, 2019.

A preliminary post-mortem report stated that the death of the disabled teenager had no criminal element, adding that she was dead from gastrointestinal bleeding due to prolonged hunger and stress. - Mkini
