Judge says court should wait for a decision on a similar case in the Federal Court as it would serve as a precedent in this case.
KUALA LUMPUR: The High Court will hear the appeal of fugitive blogger Alvin Tan’s ex-girlfriend Vivian Lee on May 11, against her jail term of five months and 22 days over a captioned photo mocking Islam on their Facebook page.
Judge Nordin Hassan fixed the date after ruling the High Court should wait for a decision on a similar case in the Federal Court as it would serve as a precedent in this case.
On May 27, last year, Vivian Lee or Lee May Ling, 27, was sentenced to five months and 22 days in jail by the Sessions Court after the prosecution proved its case against her beyond reasonable doubt.
The court however, allowed Lee a stay of execution while the appeal was being heard in the High Court.
Lee and her ex-boyfriend were charged with committing the offence at 9am, July 13, 2013 in accordance with Subsection 4(1)(c) of the Sedition Act 1948 which carries a fine of RM5,000 or three years’ jail, or both, upon conviction. -FMT
