PAS not appealing to strike out Mujahid’s defamation suit

PAS has decided not to go to the Court of Appeal to strike out Amanah vice-president Muhajid Yusof Rawa’s defamation suit against the Islamist party.

The Perikatan Nasional component party’s counsel Mohd Faizi Che Abu confirmed that his client would not contest the decision by the High Court in Kuala Lumpur not to allow the striking-out bid.

“(PAS’) Decision (is that) no appeal would be made,” the lawyer said when contacted by Malaysiakini this afternoon.

Faizi added that the civil action is set for full trial from Nov 24 to 26, 2025 before High Court judge Ahmad Shahrir Mohd Salleh.

On June 21, the civil court dismissed PAS' bid to nullify Mujahid’s defamation suit without it being subjected to a full trial.

Shahrir, in his ruling, ordered PAS to pay RM3,000 in costs to the former minister.

LGBT support claims

The alleged defamatory post purportedly appeared on PAS' official Facebook on Oct 16 last year.

The post allegedly implied that Mujahid, as the religious affairs minister under the Pakatan Harapan administration (May 2018 to February 2020), had allowed, supported, and accepted the LGBT community.

In filing the suit last January, Mujahid claimed that the post had damaged his reputation and credibility and caused him emotional stress.

The former Parit Buntar MP sued PAS via its secretary-general Takiyuddin Hassan, who is also Kota Bharu MP.

In April, PAS countered by filing a bid to nullify the civil action without its merits being heard in a full trial. - Mkini
