Late tahfiz student’s family mulls judicial review after NFA

 The family wants the courts to determine whether the probe was thorough and whether all available evidence was accounted for in the NFA decision.

The family of the late Wan Ahmad Faris Wan Abdul Rahman is considering applying for a judicial review after the investigation into the death of the Kelantan tahfiz student was classified as requiring no further action (NFA).

A representative of the family, Ali Hanafiah Mohamed, said they were discussing the matter with their lawyers, Berita Harian reported.

“So far, we are considering filing a judicial review against the NFA decision. We are also considering applying to the courts to have the investigation paper or related documents disclosed.

“This is to allow the courts to examine whether the NFA was made in accordance with the law, based on a thorough investigation and taking into account all available evidence,” he was quoted as saying.

Ali pointed out that several DNA samples were found on the clothes Wan Faris wore, questioning whether the case was classified as NFA because the DNA owner could not be found.

“Who will trace the owner of that DNA? Is it the family that needs to look for it? If no DNA had been discovered, then we would have accepted the NFA with an open heart.

“But that’s not the case here because a lot of evidence was obtained. Therefore, we will continue to move forward in seeking answers and demanding the truth.”

Wan Faris’s body was discovered by a dormitory supervisor in a toilet at the Maahad Tahfiz Sains Nurul Aman boarding school in Kok Lanas, Kelantan, on Dec 14, 2013.

A forensic pathologist who performed the autopsy initially classified the case as sudden death with no criminal elements. However, in June 2016, the coroner’s court ruled that Wan Faris had been murdered by an unidentified person.

On July 6, the Attorney-General’s Chambers classified the murder investigation into the boy’s death as NFA, saying the police had failed to uncover any evidence linking any person with Wan Faris’s death. - FMT
