Khairul Azwan should be probed for lodging false report, says Gerakan Youth

Umno Youth vice-chief Khairul Azwan Harun should be investigated for lodging a false police report alleging a high-level conspiracy against Prime Minister Najib Abdul Razak, said Gerakan Youth deputy chief Andy Yong.
"In accordance to Section 182 of the Penal Code, the police should investigate him (Khairul Azwan) for lodging a false report.
"I'm not saying he's guilty, but there is definitely a case here (to be investigated)," Yong said when contacted by Malaysiakini today.
Khairul Azwan had lodged a police report last week against former Bank Negara governor Zeti Akhtar Aziz, former Malaysian Anti-Corruption Commission (MACC) chief Abu Kassim Mohamed as well as former attorney-general Abdul Gani Patail.
Yesterday, inspector-general of police (IGP) Khalid Abu Bakar had said that Khairul Azwan's report was based on assumptions and did not warrant further investigation.
However, he also said that the Umno Youth leader would not be investigated as it did not constitute a false report.
Yong, who is a lawyer, said the police need to investigate Khairul Azwan or else it will "open the floodgates" to more baseless police reports.
People would start lodging false reports against others as they would think there are no consequences for doing so, he explained.
"It there's no investigation done, there will be an impression that the police won't take any action if false reports are lodged," he said.
Meanwhile, lawyer New Sin Yew also said that Khairul Azwan could be investigated under Section 182 of the Penal Code, which deals with giving "false information, with intent to cause a public servant to use his lawful power to the injury of another person".
However, he said, to show that Khairul Azwan is guilty under Section 182, it must be shown that the Umno Youth leader knew the information contained in his report was false when he lodged it.
"He (Khairul Azwan) must know that the information was false and he must have intended to use the police to injure or annoy those named in the report.
"It's in the public's interest to encourage the report of a crime but sometimes people lodge reports in bad faith to defame or harass others," New said.
Yesterday, PKR lawmaker Rafizi Ramli had accused Khalid of double standards for not taking action against Khairul Azwan, but the IGP had dismissed the accusations.
"Sure, I'm always the one practising double standards and he's (Rafizi) always the fair one.

"I have a lot of work to do so I'm just going to leave it at that," Khalid reportedly said.
In his police report, Khairul Azwan had claimed that Zeti, Abu Kassim and Gani were suspected of providing classified information to foreign agencies, including the Federal Bureau of Investigation (FBI), without authorisation.
Khairul Azwan also alleged that the three could have falsified the information to achieve their agenda. - Mkini
