Umno is no longer involved in the royal pardon process for Najib Abdul Razak as it is now in the Yang di Pertuan Agong's court, said party information chief Azalina Othman Said.
The minister in the Prime Minister’s Department (Law and Institutional Reform) said the king should be given space to deliberate on the matter.
"On this matter (royal pardon), the power is with the Yang di-Pertuan Agong as per Article 42 of the Federal Constitution.
"Now, there is no legal procedure. It is the discretion of the Yang di-Pertuan Agong, so we can't force it. Let the Yang di-Pertuan Agong decide and study.
"We (Umno) are no longer involved (in the process)," Azalina told reporters in Putrajaya today.
She said this in response to lawyer Mohamed Haniff Khatri Abdulla, who opined that Umno cannot file a royal pardon application on Najib's behalf.
This is because, under Regulation 113 of the Prison Regulations 2000, a petition can only be filed by the convicted, their family or a lawyer appointed by them, and the Prisons Department.
Haniff said Umno can only file a letter or petition of support to the Yang di-Pertuan Agong.
Last week, the Umno supreme council unanimously decided to appeal to the Yang di-Pertuan Agong to pardon Najib
The council will also present to the monarch a memorandum signed by all 191 Umno division leaders.
