Cyberbullying culprits should be jailed, not fined, Esha's mother says

The mother of cyberbullying victim Rajeswary Appahu, better known as Esha, believed the perpetrators who caused her daughter to commit suicide should be jailed instead of fined.

This comes after the Kuala Lumpur Magistrate’s Court yesterday punished a welfare homeowner with a maximum fine of RM100 after she pleaded guilty to a charge linked to the bullying.

Esha’s mother R Puspa reportedly expressed her grief over the punishment, which was further aggravated when she saw the accused P Shalini smiling while exiting the Kuala Lumpur court complex later.

“It breaks my heart that Shalini smiled and walked out confidently. The ones who did wrong walk free, and the ones who did right are buried,” Puspa said, as quoted by news portal Scoop.

Adding further, the grieving mother rued that the punishment was akin to saying that anyone can get away with cyberbullying just by paying a small fine.

“They should have had a heavier sentence. I am not saying they should be put to death, but they should be in prison for at least five years,” Puspa reportedly said.

RM100 fine

Yesterday, it was reported that Kuala Lumpur magistrate S Arunjothy handed the maximum sentence of a RM100 fine against Shalini, 35, after she pleaded guilty to a charge under Section 14 of the Minor Offences Act 1955.

She was accused of uttering offensive words intended to provoke anger at around 4.10am on July 1 through her TikTok account “alphaquinnsha”.

The Kuala Lumpur Sessions Court had postponed the sentencing of lorry driver B Sathiskumar, 44, after he pleaded guilty to a charge related to Esha’s bullying.

He reportedly was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998 for posting lewd comments under the profile “@dulal_brothers_360” at 10.12pm on June 30 with the intention of annoying others.

Sessions Court judge Siti Aminah Ghazali decided to postpone sentencing against the accused to allow him time to find a lawyer.

Sathiskumar however claimed trial to another charge under Section 509 of the Penal Code for allegedly posting lewd comments with the intention to outrage the modesty of Puspa at 10.15pm on the same day.

Esha, an influencer, was found dead on July 5, just one day after filing a police report regarding criminal threats and defamation on social media against her. - Mkini
