DAP chairperson Gobind Singh Deo has urged the attorney-general Dusuki Mokhtar to explain the long wait for justice for victims of the Durian Tunggal shooting in November last year.
He noted that there is still no definitive legal action after eight months, even though the police have reclassified the case as murder since December.
“The police do not reclassify cases, especially to serious capital offences such as homicide, unless there is a solid evidential basis to do so.
“The fact that the enforcement agency itself determined that the threshold for a murder investigation was met indicates that there is evidence requiring urgent court action,” he said in a statement today.
Any delay in prosecution will affect the quality of evidence, as witness recollections fade, physical evidence degrades, and procedural gaps could emerge.
Gobind (above), who is also the digital minister, urged the attorney-general to take action without further delay and said he will raise the issue in tomorrow’s cabinet meeting.
“The victims' families have waited eight months for justice, and public confidence in the criminal justice system is at stake,” he added.
Three people, aged 24 to 29, were killed in the incident on Nov 24 last year.
Shot at extremely close range
Earlier today, lawyer Rajesh Nagarajan revealed autopsy reports of the victims, indicating that they were shot at extremely close range at a downward angle.
He argued this is inconsistent with the police’s claim that its officers shot the trio in self-defence when one of them allegedly attacked the police with a machete.
“This is murder,” he said.
He further claimed that the police refused to hand over the post-mortem reports to the victims’ families, forcing them to pay RM3,000 to obtain the reports from Melaka Hospital.
In light of the post-mortem findings, Rajesh said the families of the three shooting victims demand that all police officers involved be detained and remanded on murder charges.
They also demanded an explanation from the prime minister, the inspector-general of police, and the attorney-general for the delay in taking investigative action on the case. - Mkini
