An Umno deputy minister in the prime minister's department Datuk Mashitah Ibrahim had recently interpreted the Federal Constitution's Article 8, Clauses 1 and 2 that the lesbians, gays, bisexuals and transgenders (LGBT) are not constitutionally protected under the nation's highest law.
LGBT people are not humans? Is that what the BN government had interpreted as stated by the deputy minister? If these LGBT people are not humans, then how do the government categories them and what will you do to them if the authorities were to detain them? Are you going to put them in cages or send them to the nearest zoo? Can any other members of the BN government come forward to clarify this?
In the Article 8 of the Federal Constitution, the clauses herein mentioned the following:

In the Article 8 of the Federal Constitution, the clauses herein mentioned the following:
- All persons are equal before the law and entitled the equal protection of the law.
- Except as expressly authorized by this Constitution, there shall be no discrimination against citizens on the ground only of religion, race, descent, place of birth or gender in any law or in the appointment to any office or employment under the public authority or in the administration of any law relating to the acquisition, holding or disposition of property or the establishing or carrying on any trade, business, profession, vocation or employment.
In these two clauses as well as the third, fourth and so on, it did not specifically mention that the LGBT people are constitutionally excluded from protection. In clause 2 it is only simply described as "gender" without specifically referring to that of a man or woman or whichever described as.
In this case, in what way would the deputy minister would confirm that her interpretation is correct or accurate and from which part of any articles in the Constitution that supports her interpretation or whatsoever she alleged.
By casting out the LGBT people from the human race is definitely against the human rights by convention. Even if these LGBT people are considered abnormal due to instability of their gender since birth does not mean that they are unfit to be humans.
As such, they should not be ill treated and discriminated from the others. Necessary assistance ought to be provided to these LGBT people, such as provision of proper jobs, care, training and so on, so that they could earn a decent living just like anyone of us.
If they are discriminated at, threatened, bullied or being labelled as non-humans, you are making them all as out-laws and in the end, they would end up in many unhealthy or vice activities which of which we are trying our best to prevent it.
So, why do this BN government wanted to encourage more negative elements by refusing them human status and equality?
We strongly believed that the majority in the LGBT community are not criminals nor in the vice rings as usually claimed by the authorities.They are human beings too, have their rights for a decent living, shelter, care, love and they are Constitutionally protected. Even religions do not mention LGBT as non-humans.
