Round 1 to septuagenarian seeking citizenship



Permanent resident R Kolandavaloo has won leave (permission) to initiate a judicial review of the National Registration Department’s (NRD) decision to deny him citizenship and a blue MyKad.

NONEJustice Zaleha Yusof delivered her ruling in the Kuala Lumpur High Court today, said lawyer M Manoharan(right) who is representing Kolandavaloo, 70.

The ruling was made over an objection by the Attorney-General’s Chambers, which represented the home minister, NRD director-general and the federal government.

Kolandavaloo, a plumber by trade, had filed the judicial review application in February to quash the NRD decision not to issue him a citizenship certificate and a blue MyKad on the basis of “bad character”

Kolandavaloo, who argued he does not have a criminal record to warrant any such description, is seeking a mandamus order to compel the respondents to issue the personal identification documents.
He is also seeking general damages, costs and reliefs that the court may deem fit. 

NONEIn his application, Kolandavaloo claimed that the NRD's refusal to issue him a MyKad is a violation of Article 16 of the federal constitution.

He said the decision is subjective, that the reasons given do not satisfy the rules of natural justice, and that the NRD has acted without any reasonable excuse in judging him to be a person of "bad character”.

Kolandavaloo has been a permanent resident since 1980 and holds a Malaysian birth certificate, although his parents are from India. He is married to a Malaysian and has children who are also citizens.
