Engineer jailed and fined for up skirt video

The victim screamed for help when the accused refused to show her his mobile phone.

KUALA LUMPUR: A factory engineer was sentenced to five days’ jail and fined RM4,000 by the magistrate’s court here today for video recording the thighs of a woman while she was taking the escalator.

Magistrate Nur Azura Murah handed down the sentence on Nasrul Aizat Zulkifli, 25, after the accused pleaded guilty to outraging the modesty of a 29-year-old woman, by recording a video up her skirt using his mobile phone last Saturday.

The court ordered the accused to serve the sentence from the date of his arrest on June 13, and also ordered him to serve a five-month jail term if he failed to pay the fine.

The accused was charged with committing the offence at the escalator in Low Yat Plaza, here at 6.30pm on June 13.

He was charged under Section 509 of the Penal Code which provides for a maximum prison sentence of five years or a fine, or both.

According to the facts of the case, the victim who was taking the escalator to the first floor realised the man was putting his phone under the skirt she was wearing.

The victim then asked the accused to show her the mobile phone, but he refused to do so causing the victim to scream for help.

Several staff at the plaza who heared the screams later helped the victim nab the accused.

The victim then examined the accused’s mobile phone and found a video showing part of her thigh.

During the appeal, the accused, who was represented by P. Muniswer, requested the court to impose a minimum fine on the grounds that it was the first offence and the accused had repented.

“The accused has been remanded for three days, which is a lesson to him not to repeat the mistake,” he said.

Deputy public prosecutor Ezrene Zakariah requested the court to sentence the accused to a punishment which would serve as a lesson to others, taking into account the fact that the actions of the accused had caused emotional distress and trauma to the victim.

“The action can also generally affect the safety of other women and girls,” she argued.
