LIE AFTER LIE: Now bankrupt Ramesh Rao insists he's not NGO chairman BUT checks show otherwise
KUALA LUMPUR - Exposed as a bankrupt, Ramesh Rao Krishna Naidu is now claiming to be an “ordinary” member of Pertubuhan Minda dan Sosial Prihatin that is behind videos accusing Sarawak Report of forgery.
But a check with the Registrar of Societies (RoS) online e-ROSES database showed him listed as the chairman of the non-governmental organisation for the year 2015, despite the Societies Act 1966 prohibiting undischarged bankrupts from holding any office in registered groups.
When contacted for clarification, Ramesh ― who is variously described in news reports of the exposés as the “chairman”, “head” and “president” of the group releasing controversial videos claiming of a conspiracy involving 1Malaysia Development Bhd (1MDB) ― insisted he is not the head of the organisation.
“I’m no longer a president, only a ordinary member now,” he told Malay Mail Online when contacted yesterday.
To support his claim, he also sent a screen capture of what appears to be the group’s committee list purportedly logged with the RoS, which showed a Sumathi Naranasamy as the chairman.
The image, however, contradicts Ramesh’s claim that he was not an office holder as it shows that he was on the group’s committee.
The screenshot also differs from the roll Malay Mail Online obtained from the e-ROSES database, which lists Sumathi as Ramesh’s deputy for 2015.
Another committee member, Tony Tan, was also accused of being a bankrupt by DAP MP Tony Pua who posted what appears to be a document from the Malaysian Department of Insolvency that showed the former to be listed in its database.
According to Section 9A (1) (d) of the Societies Act 1966, a person is disqualified from being an office bearer in any registered society if “he is an undischarged bankrupt”, among others.
A person who contravenes the provision may be liable for a jail term of no more than three years or a fine of RM 10,000 or both, upon conviction.
When contacted, RoS director-general Mohammad Razin Abdullah said there is no exception for a bankrupt to hold any sort of office in any society registered with his agency.
“Under our Act, someone who is bankrupt cannot hold any positions. There is no way for that to happen,” he told Malay Mail Online when contacted.
He added RoS has not taken any action on Ramesh or his NGO as they have not received any complaints on the matter yet.
“So far we have not been alerted about this case as there has been no complaints. Maybe after this, we will look into this,” Razin said, adding that a bankrupt cannot even be a committee member and was restricted only to ordinary membership.
Attempts by Malay Mail Online to seek further clarification from Ramesh have since been ignored.
Earlier yesterday, Ramesh was forced to admit to being a bankrupt after a document was circulated online showing his listing on the Malaysian Department of Insolvency database.
He maintained that although he was an undischarged bankrupt, he was not on the Immigration’s no-fly list as he has been regularly repaying his debts since 2013.
Malay Mail Online confirmed Ramesh’s bankruptcy via a check with the Department of Insolvency.
Ramesh entered the spotlight after he released a video of former Sarawak Tribune editor Lester Melanyi claiming an alleged conspiracy involving Sarawak Report and Malaysian opposition politicians to forge documents on 1MDB.
According to Lester, the forged documents were subsequently used by the whistleblower site to discredit Prime Minister Datuk Seri Najib Razak.
The credibility of the allegations were first dented when the former journalist admitted to being paid to expose Sarawak Report and once more when the picture of UK rail manager was wrongly used in a second video that identified the alleged forger.
