The Malaysian Bar today cautioned police against using Section 124B of the Penal Code, which relates to activity detrimental to parliamentary democracy, against those exercising their democratic right to assemble peacefully.
Bar Council president Steven Thiru said the use of Section 124B against the 17 people for participating in a peaceful sit-in outside the Parliament building earlier this week was not justified.
Steven said this provision should not be misused to erode the constitutional right enshrined in Article 10(1)(b), read with 10(2)(b), of the Federal Constitution – to assemble peacefully and without arms.
"It would be a gross abuse of Section 124B if it were to be used to cause fear or anxiety among members of the public," he said in a statement issued ahead of the 34-hour Bersih rally which begins tomorrow.
