I do not have the foggiest idea about diplomatic relations between states, diplomatic immunity and such; but offhand, this is what I think of your question in relation to :-



NAJIB : How does the sitting French judge propose to summon a sovereign head of government without causing a diplomatic scandal? Would the French government request the Malaysian government to extradite Najib to Paris? That would be a laugh wouldn't it? On the assumption that Najib ignores the summons to appear before the French judge, would the latter find Najib in contempt of his court? If it were to be the case, wouldn't you think that that would soil Franco-Malaysian relations? All the above aside, would Paris - through its attorney general or whatever the French calls the holder of that office - allow an insult be delivered to a sovereign state it has friendly relations with; regardless of Najib's complicity - real or apparent - in the Scorpenes/Altantuya mess? I don't think so. Then again, what do I know about international and diplomatic relations between independent and sovereign states.

RAZAK B : The French court could, of course, summon him from wherever [London?] he is currently domiciled. But the court needs to find where he is first. On the assumption that he is located, it does not mean that will attend court of his own volition. If he refuses to amuse the French judge summoning him, what then? Extradite him to Paris? I don't think Razak would take that sitting down. I'm almost sure his patron in Putrajaya would hire a reputable QC in the area of extradition and inter state relations to ensure that Razak would have his day in court. Alternatively, Razak could move into a town that has no extradition treaty with Paris.

Neither am I schooled in law; so what do I know about things extradition?
