Govt must apologise to PSM-6 and not charge them, says Surendran

Prime Minister Najib Razak has been urged to drop all charges against the six Part Sosialis Malaysia leaders, who have already spent 28 days in detention without trial on bogus charges of rekindling Communism and waging war against the King.

To try to further punish would be to heap "outrage upon outrage", slammed PKR vice president N Surendran.

"We condemn the further persecution of these innocent and brave individuals by the Government, police force and Attorney General's chambers. Charging them after having detained them without trial, is the heaping of outrage upon outrage. This ill treatment of 6 dedicated social & political activists is an affront to the Malaysian people's sense of justice," Surendran (right) said in a statement out on Tuesday.

"The fact that the PSM 6 are being charged once again highlights the failure of key national institutions such as the police and prosecution bodies which are meant to act in the public interest. The charging of the PSM6 is done not in the public interest, but in the interest of the BN government. We demand that the planned charges against the PSM6 be dropped and that the Government apologises to the PSM6 for their unlawful and politically motivated detention under the EO."

The EO is an oppressive law that allows the Malaysian government to detain all suspects including political rivals without trial for an indefinite period of time.

Another pathetic political maneuver

The six Parti Sosialis Malaysia detainees are Sungai Siput MP Dr Michael Jeyakumar Devaraj, Choo Chon Kai, Sarat Babu, M Sarasvathy, M Sukumaran and A Letchumanan. They were released on July 29 to a grand hero's welcome but are not out of the woods yet.

They have to go to court in Butterworth on Friday, where they will be formally charged at 9am. All eyes are on whether the Najib administration will continue to pin the Communism and treason charges against them. Those were the intial bizarre charges slapped on them by a police force, under pressure to create an atmosphere of fear amongst the people to stop them from upporting the July 9 Bersih 2.0 rally for free and fair elections.

The PSM leaders had been travelling to Penang to take part in a Bersih roadshow. Given the huge unpopularity Najib suffered as a result of the high-handed move, he is expected to come off his high horse, and charge the six for being involved in Bersih 2.0-related activties

PSM secretary-general S Arutchelvan has since confirmed the six will be charged under Section 43 of the Societies Act or alternatively Section 48 (1) of the same act. Section 48 states that anyone who acts on behalf of or represents an unlawful society by bringing with them 600 photocopies of pamphlets is liable to a maximum penalty of five years' jail, a fine of up to RM5,000, or both.

Polls watchdog Bersih is still illegal, with Home Minister Hishammuddin Hussein refusing to lift the ban on the movement that Najib has insisted was trying to topple his government and create chaos.

"This is just another pathetic political move by the Attorney General to pretend to give a semblance of having some basis for the earlier detention," PKR legal affairs director Latheefa Koya told Malaysia Chronicle.

Indeed there is growing resentment amongst the Indian community that Najib was just using the PSM-6 to gain popularity for him ahead ahead of the MIC annual meeting on Saturday. The PSM-6 were suddenly released the day before, with Najib insisting that this was not unusual but based on "the law".
