DUBIOUS VOTERS: Nurul Izzah to appeal High Court decision
KUALA LUMPUR - PKR vice-president Nurul Izzah Anwar will appeal the High Court's dismissal of her application to compel the Election Commission (EC) to strike out "dubious" voters in the Lembah Pantai electoral roll.
Her lawyer, Edmund Bon, said the appeal will be filed by May 5.
"On the same day the application was dismissed (April 4), we wrote to High Court judge Zakaria Sam asking for grounds of judgment in order to analyse why the case was dismissed, but until today we have not received it.
"We are therefore going ahead with the appeal first," he told a press conference today.
Nurul Izzah had, on March 22, applied for a judicial review to compel the EC to clean up the electoral roll in Lembah Pantai.
She had filed the application together with a registered voter, Kadir Sultan Abdul Majid, requesting that 4,637 "dubious" voters be struck off the electoral roll.
Zakaria had dismissed the application deeming it illegal and invalid, saying the court has no jurisdiction to review, quash or set aside the electoral roll once it has been gazetted.
However, Bon said three names they had brought up had been removed from the roll following the court's decision.
"We find this to be inconsistent on the part of the EC, which claims it is powerless once the roll has been gazetted but yet can make such changes," he said.
Meanwhile, in response to claims that Nurul Izzah was trying to remove genuine voters from the roll, her political secretary Fahmi Fadzil said the case was against the EC.
"We are not attacking the voters, we just want to ensure that the details entered into the EC's records are complete and genuine," he said.
