WHISTLE-BLOWERS NOT PROTECTED IF INFORMATION SHARED WITH MEDIA, SAYS FORMER LAW MINISTER

(The Rakyat Post) – Protection under the Whistleblower Protection Act 2010 is forfeited if information is divulged to the media, said former Law Minister Datuk Zaid Ibrahim.
“There’s no protection, it’s just called that (Whistleblower Protection Act 2010). You can only divulge information to police or authorities.
“If you go to the press you are not covered. Also, if you are in breach of any law, like the Official Secrets Act 1972, again you are not covered,” Zaid told The Rakyat Post when contacted.
He was asked to comment on whether those involved in the revelation of information on the 1Malaysia Development Bhd (1MDB) scandal could be protected under the Act if they obtained stolen information.
“It’s not even to protect whistle-blowers. It’s just another legislation to make Malaysia look good. The thing with this issue is, they are not interested in the truth of the whole thing.”
Several have been calling for those involved including Tony Pua, Rafizi Ramli andThe Edge heads to be protected under the Act for revealing the information.
Under section 11 of the Whistleblower Protection Act 2010, it states that the enforcement agency shall revoke protection of the whistle-blower if investigations showed that “the disclosure of improper conduct principally involves questioning the merits of government policy, including policy of a public body” or if the disclosure was “of improper conduct is frivolous or vexatious” among others.
