YOURSAY | ‘Stop harassing a lawyer who's doing his job. Go after hardcore criminals.’
Tholu: Mr IGP (inspector-general of police Khalid Abu Bakar), if you are investigating Charles Morais and his lawyer Americk Sindhu under section 202 of the Penal Code for withholding information pertaining to a crime, then you are implying that the murder that Charles insinuated in his SD (statutory declaration) is indeed true and was actually committed by certain people in power.
On the other hand, if such a crime was not committed, then there cannot be any withholding of information and the investigation under section 202 would appear foolish and senseless.
So, which is which, Mr IGP?
Aries46: The IGP seems to spew a lot of intimidating sounding words such as “coward”, “run away”, “serious SD”, “section 202”, “section 124L” and so on, but he fails to elaborate what exactly Charles's wrongdoing is that has so enraged him.
Charles appears to have come with a specific purpose in respect of his late brother Kevin's murder, made his SD and held his press conference and left through the Causeway not as a fugitive or as a wanted person.
If he had committed a serious crime, was he summoned by the police and why was he allowed to leave the country? Or did he evade the police dragnet?
Nevertheless, if his crime is really serious I'm sure the Interpol will be able to bring him in, provided the PDRM (Royal Malaysian Police) has the justification to drag him back to Malaysia.
P Dev Anand Pillai: Come on Mr IGP, it is client-attorney privilege as provided for by Section 126 of the Evidence Act 1950.
Get Charles, not Americk. The police seem to be making the same mistake, time and again.
The only way to put a stop to the rot is for the people to rise up but unfortunately, the ruling elite know that Malaysians are not made of that mettle so they continue with their ways, and we the people bear the brunt of a complete failure of the system of checks and balances in this country.
Benghazi: Using bully tactics, huh, Mr IGP? A lawyer helps a client to put his SD in the proper legal format and employing the appropriate legal jargon. The actual content must come from the client.
Stop harassing the lawyer who is only doing his job. Go after hardcore criminals who steal from the rakyat. It's important that the IGP gets his priority right. The taxpayers are paying his salary.
Saya Pun Nak Cari Makan: Khalid, you are the worst IGP the country ever had. Americk acted on the instruction of his client. He drafted the SD according to what is dictated by Charles.
And, remember preparing SD is part of his profession, a legal one. His duty ends the moment the client agreed to the contents and duly endorses it.
What you should be acting on, is the allegation - a very serious one where PM Najib Razak is allegedly implicated.
Charles is not running away like a coward, but you are. If you are brave, the first thing is to go after Najib. If indeed that you cannot uphold fairness, please resign.
Beeep: So, isn't it high time for the IGP to call up lawyer Cecil Abraham and his son for writing that most serious of SDs on behalf of the late private eye P Balasubramaniam.
Vijay47: Considering the issues that you are so concerned with, Khalid, it is evident that you have forgotten that you are the IGP, an office thrust on you by the Agong himself to protect the nation and bring crooks and sundry vermin to book.
This lapse of memory could be due to your craving to serve political masters, or some neurological malady; either way, you are unfit to hold the top position in the police force, not with your snarling bullying ways.
You seem free in using words like "run away" and "fled" which, apart from revealing Charles' animal instinct to survive, would be more appropriate to describe you and your flight from duty and responsibility.
You now threaten Americk on the grounds that the SD contents are serious. If such be the case, why are you not investigating the "serious" allegations?
Americk will be around, his contempt for you would hardly cause him to fear you.
Anon1: "To assist in police investigations" nowadays mean to be remanded and locked up under laws allowing detention without trial.
Would you blame these complainants for running away then?
Sabahan: Such a silly reply. The IGP can only understand short statutory declarations. Long SDs will require the lawyer drafting it to come to the police station to help the IGP understand it.
The lawyer is just doing his job, whether the statutory declaration is just one sentence or a 100-pages long, there is no necessity for the lawyer to explain.
2Kali5: Now watch out all you commissioners of oaths and lawyers. You stand to be hauled up for attesting to your clients' SDs. -Mkini
