This is from Malaysiakini. Salleh Syed Keruak seems to be detailing the method to constitutionally oust Najib.
Citizens' Declaration, to be submitted to Agong gathered a million signatures
The declaration calls for (constitutional and legal) removal of Najib
Salleh said there is no legal provision for Agong to do this.
"..in a democracy that (petition) is allowed
according to law or Constitution there is little His Majesty can do about this petition
- prime minister’s own party has to do that or
- MPs from prime minister’s party have to cross over to the opposition
- Salleh said in a blog posting today.
government often told to respect and observe the constitution
if prime minister loses confidence of majority of Parliament then he has to step down
- Among ways to achieve this is vote of no-confidence against prime minister or
- for members of ruling coalition to cross over to opposition
- "Other than that, His Majesty’s hands will be tied," Salleh added. - M'kini
My comments : Thank you Salleh Keruak for outlining this for the people's easy understanding.
Please tell your fellow Sabahan Pandikar Amin who is no less than the Speaker of the Parliament, so that he may also understand this simple concept.
Pandikar has said that there is no proviso in the Constitution / or in the Rules of the House for a vote of no confidence. He says he will not entertain any motion to move for a vote of no confidence against the PM.
That was an illegal and unconstituional stamenent by the Speaker of the Parliament. Maybe one day (not too far away) Pandikar will be held criminally liable for saying that in his capacity as Speaker of the Parliament.
(Just like that other moron must beheld criminally liable for saying that there was no case against the thief.)
Folks here is a secret : There is actually no need for an actual vote of no confidence against the PM. No need for show of hands etc.
The BN has 134 (?) seats. The Opposition has 88 to give a total of 222 seats.
If 23 MPs from Sarawak (oops...from the BN) physically get up from their chairs and walk over and sit on the opposite side (no need to sit with the Opposition parties) then it will be game over for Najib. No need for an actual vote of no confidence. It is all fully legal, fully Constitutional.
The day after Najib is ousted, the 23 MPs can again physically get up and walk back to their old seats and choose a new PM. Its as simple as that.
Adenan Satem must realise that his huge landslide can become totally useless in just 25 months (June 2018) when Najib loses the next general election.
To all you doubters out there, Najib is the first PM to have lost the popular vote in 2013. Despite all the money and the power he only secured 48% of the votes.
If you think he will do any better in 2018 you must be more stupid. Just 1% or 2% more will see the end of the BN.
Then where will Adenan Satem be? Or UMNO Sabah? You will be gone in no time at all. There is no money in the world that can buy off such a situation. Meaning there is not enough bribe money (for 23 Sarawak MPs) that is worth sacrificing the future of Sarawak.
It is in the interests of Adenan Satem to see Najib be gone now and be replaced by someone else. Before 2018.
Better be in control of the situation now than to be lost in an "out of control" situation later. You really dont know what will happen in 2018 if Najib remains in power.
Err..can 23 Sarawak MPs get up and move over? Forget about the money for a while ok?
