The Socialist Party of Malaysia (PSM) lodged a police report today on the use of an unfitting section of the Penal Code in the probe over the alleged assault of a truck driver.
Political activist Khalid Mohd Ismath of Pemuda PSM said the investigation under Section 147 (punishment for rioting) should instead be under Section 325 (punishment for voluntarily causing grievous hurt).
“They did not induce a riot but they attacked someone, they injured someone. We believe Section 325 is better suited (for this case).
“To me, Section 147 is an investigation that will free (the assaulters) of charges,” said Khalid at the Jalan Travers police station.
He added that his report was based on the posting in the PDRM Facebook.
The activist also asked why the police are not releasing the names of those they have arrested in this case and the 'Datuk' who was allegedly involved.
“We have no details (on the people involved). We have asked the police to release the name of the 'Datuk', why are they so afraid to give away his identity?" said Khalid.
However, it was reported that inspector-general of police Khalid Abu Bakar had denied a 'Datuk' was involved in the incident.
Pemuda PSM said they lodged the police report on behalf of the victim, as they would rather let him rest at home with his family.
“He is a victim of a traumatic event and it would be best for him to get his rest.
“We have been in contact with him, but would like to file this police report as soon as possible,” said Pemuda PSM member Sharan Raj.
The truck driver allegedly reversed his truck onto a luxury car, which resulted in an altercation at Ampang, Selangor.
One man pinned him down as several others continued to beat him.
The truck driver, Nasrul Faiz Zulfahmi, 25, said he had accidentally reversed his truck into a parked Mercedes-Benz.- Mkini
