KUALA LUMPUR: Former Bank Rakyat chairman Abdul Aziz Zainal and former managing director Mustafha Abd Razak were freed by the Sessions Court here today of charges related to criminal breach of trust (CBT) over a book project involving nearly RM15 million.
Judge Madihah Harullah acquitted the two after deputy public prosecutor Afzanizam Abdul Aziz told the court that the Attorney-General’s Chambers (AGC) had decided to withdraw the charges against them.
“Both accused are discharged and acquitted,” she said, adding that their bail amounting to RM800,000 was to be refunded.
Mustafha claimed trial two years ago over a CBT charge amounting to RM14.9 million in a book project for the biography of a prominent figure. Aziz, meanwhile, was accused of abetting him.
They allegedly committed the offences at Bank Rakyat’s office here in March 2016.
Mustafha and Aziz were replaced as managing director and chairman by Zulkiflee Abbas Abdul Hamid and Shukry Mohd Salleh last year.
Mustafha’s lawyer, Kamarul Hisham Kamaruddin, said his client thanked the AGC for its “thorough reconsideration” of the charges against him and Aziz.
He said he had sent a representative letter to the AGC on June 1, asking that the charges against the duo be dropped.
Meanwhile, Aziz said he had been vindicated by the prosecutor’s decision to drop charges against him.
“Our family members also suffered because of our criminal charges, and now the truth has prevailed.” -FMT
