The Singapore High Court has dismissed an application for leave by Malaysian P Pannir Selvam to appeal a previous decision denying his request for documents to fight his death sentence.
Following the decision, made on Monday this week, Malaysiakini understands that his lawyers will next make a discovery application to the city-state’s Court of Appeal for the documents.
This is to aid Pannir, who is on death row for a drug trafficking charge, in his legal challenge against Singapore President Halimah Yacob’s rejection of his clemency application.
His original discovery application was dismissed by the High Court on July 19.
His family’s Malaysian lawyer, N Surendran, urged the Singaporean judiciary to be more forthcoming in allowing the 32-year-old access to information.
“The Singapore Attorney-General (Lucien Wong) should be transparent and allow the material to be given to Pannir [...] Among the information he is seeking are the particulars and a call trace report for a particular mobile number.
“His life is at stake,” he told Malaysiakini when contacted.
Pannir’s lawyers Too Xing Ji and Lee Ji En have also filed for two judicial reviews - one challenging the clemency rejection process and another disputing his failure to be given a Certificate of Substantive Assistance.
The proceedings will begin once hearings for the discovery application are completed.
In May this year, the Malaysian was granted a stay for his execution one day before it was scheduled to take place.
This was after Too and Lee stepped in at the eleventh hour to represent him, contending successfully that Pannir had a right to legal advice to challenge his clemency rejection.
Pannir was convicted on June 27, 2017, for trafficking 51.84gm of diamorphine (heroin) at the Woodlands Checkpoint three years prior. - Mkini
