Court strikes out Harapan's challenge on PN's victory in Suka Menanti

The Election Court has struck out Pakatan Harapan’s petition seeking to annul Perikatan Nasional’s victory in the Suka Menanti state seat during the state election in Kedah.

Alor Setar High Court judge Quay Chew Soon this morning allowed the Election Commission’s (EC) preliminary objection against the election petition by Harapan candidate Zamri Yusuf.

When contacted, federal counsel Sallehudin Md Ali, who was among the EC’s legal representatives, confirmed the outcome of the Zoom proceedings.

The preliminary objection was over the EC’s contention that Zamri failed to provide sufficient particulars over his allegation against the electoral authority.

Through the election petition, Zamri alleged that EC failed to abide by election laws when conducting the Kedah polls, thus purportedly causing Dzowahir Ab Ghani’s victory to be invalid.

The Harapan candidate also alleged among others that PN’s electoral victory was not valid as the EC did not allow postal, polling and counting agents from entering the polling stations.

In agreeing with the EC’s objection, Quay ruled that Zamri’s petition was defective, and ordered the petitioner to pay RM15,000 cost to the electoral authority.

During the recent six state elections including in Kedah on Aug 12, Dzowahir clinched Suka Menanti with 18,396 votes, while Zamri only polled 10,151 votes in the straight fight.

Besides Sallehudin, the EC was also represented by senior federal counsel Ahmad Hanir Hambaly and Nur Idayu Amir.
