THE son of former MIC president S. Samy Vellu has filed an originating summons to determine if the former works minister is mentally sound and in a position to manage his affairs, The Edge Financial Daily reports today.
The Kuala Lumpur High Court received the application from S. Vell Paari on December 2.
Vell Paari is seeking an inquiry under the Mental Health Act 2001 to determine whether his father, who is 82, is of sound mind.
The son wants his father and his medical record to be accessible for examination by Neurobehavioural Medicine head at the Penang Adventist Hospital, Dr Prem Kumar Chandrasekaran.
Vell Paari, a former secretary general for MIC, wants an inquiry to be held into his father’s mental health condition and for Samy Vellu to be summoned to court.
Should Samy Vellu be found to be mentally unstable, Vell Paari wants the court to appoint him and anyone else the court deems fit to a committee managing his estate.
Vell Paari also wants the court to determine the powers of the committee, make provisions for costs and expenses, in the case it agrees to form such a committee.
In his affidavit, Vell Paari said his mother and sister are aware of his application to the court and that they wished to be made a litigant representing his father.
Vell Paari cited the findings of a Professor David Ames and a Dr Bharathi who have both examined Samy Vellu.
Vell Paari said that his father’s former mistress, whom he identified as Meeriam, has initiated legal proceedings at the Ipoh High Court against Samy Vellu and himself, which he had disputed.
As such, he seeks to have the inquiry in Kuala Lumpur be disposed of before Meeriam’s case is heard.
Case management takes places today before the High Court deputy registrar.
