Myvi driver in JB fatal accident jailed six years, fined RM11,300

 


The lady driver of a Perodua Myvi which was involved in a three-vehicle collision which killed a navy personnel near Plaza Pelangi here last Saturday was sentenced to six years’ jail and fined a total of RM11,300, in default 19 months’ jail, by the Johor Bahru Magistrate’s Court today.

Magistrate Suhaila Shafi’uddin handed down the punishment on Nur Fatin Nasrah Suhaimi, 23, after she pleaded guilty to all four charges in connection with the fatal crash.

The woman also lost her eligibility to hold and renew her driving licence for five years.

Suhaila sentenced Nur Fatin Nasrah to six years’ jail and fine of RM8,000, in default six months’ jail, on the first charge with driving under the influence of drugs.

On the other three counts, she was charged with driving without a valid driving licence, using a vehicle without a road tax and insurance, for which she was fined RM1,500, in default six months’ jail, RM1,000 (four months’ jail) and RM800 (three months’ jail), respectively.

According to the charge sheet, Nur Fatin Nasrah, who is a factory worker, was charged with driving a vehicle, with registration number JPF3431, when under the influence of drugs. This resulted in her losing control of her vehicle and crashed into another vehicle, with registration number JMJ 5558, thus causing the death of its driver, Mohd Rizal Buseri, 31.

The crash occurred at a traffic light intersection at Kilometre 4 Jalan Johor Bahru-Kota Tinggi at 8.24am last Oct 10.

She was also charged in another Magistrate’s Court with an offence under Section 15(1)(a) of the dangerous drugs Act 1952 with self-administration of the drugs, methamphetamine and amphetamine, on the same day.

Magistrate R Salini sentenced her to seven months’ jail and to be placed under probation for two years, with the jail sentence to be served consecutively.

Earlier, in mitigation, Nur Fatin Nasrah apologised and expressed her remorse to the victim’s family for her action.

She also requested the court to take into account her responsibility to support her parents and siblings when meting out the sentence on her.

However, the prosecution, represented by deputy public prosecutors Tengku Amir Tengku Abdul Rahman and Noridayu Md Kassim, requested for a sentence the commensurate with the offence, which should not be taken lightly, to send a message to the public on the seriousness of the offence for driving under the influence of a drug.

Meanwhile, Nur Fatin Nasrah’s fiance, Nuraiman Fathi Mohd Zukki, 23, who is the owner of the Perodua Myvi car, pleaded guilty to charges of allowing his fiancee, who has no driving licence and not covered by insurance to drive the vehicle which had no road tax.

Magistrate Suhaila fined him a total of RM3,300, in default 13 months’ jail and also disqualified him from holding a driving licence for 12 months, effective today.
