Open court criminal trials not allowed in enhanced MCO areas: minister

 


Open court criminal trials in enhanced movement control order (MCO) areas are not allowed to operate, according to Senior Minister (Security Cluster) Ismail Sabri Yaakob.

In a media statement today, the defence minister said that only online proceedings for civil court actions are allowed to operate during Phase 1 of the National Recovery Plan (NRP) including in enhanced MCO areas.

“For criminal case trials, they are also allowed to operate during Phase 1 except for areas under an enhanced MCO.

“For civil cases including tribunal cases, they are allowed to operate via online including in enhanced MCO areas,” he said.

In regards to commissioners of oath, Ismail Sabri said that the National Security Council (NSC) has also allowed them to operate during the Phase 1 NRP except in enhanced MCO areas.

Commissioners of oath play a role in helping lawyers and other legal practitioners affirm documents to be used in court proceedings among other sectors.

“The permission is after taking into account that commissioners of oath play an important role in giving support to the conveyancing (land) sector and banking as well as operations involving contracts and commerce,” Ismail Sabri said.

Yesterday, it was announced that several parts of Selangor and Kuala Lumpur would be subjected to a stricter lockdown from tomorrow until July 16.

The rules for enhanced MCO in these parts are mostly the same as the current "total lockdown" rules.

The exceptions are as follows:

1. Only one person is allowed to leave the house for necessities.

2. Only factories producing basic necessities - food, masks and medicine - are allowed to operate.

3. Enhanced MCO areas will be subjected to "targeted" Covid-19 tests.

4. Entry points into enhanced MCO areas will be guarded by the police.

These rules will be imposed from July 3 until July 16.

This will affect 34 subdistricts in Selangor including Cheras, Kajang, Klang and Setapak. A total of 14 localities in Kuala Lumpur will also be affected (see list below). - Mkini
