The murder charge against a 15-year-old accused of killing her newborn baby boy in Kemaman, Terengganu can be reviewed, said the Attorney-General's Chambers (AGC).
This is in light of the results of investigations into her rape last year.
"Prosecutors can review the decision to charge her under Section 302 of the Penal Code to a different charge after taking into account additional developments including the investigation result on the rape incident against this child," the AGC said in a statement today.
On Feb 8, police were alerted to the death of a newborn infant at the teenager's home in Kemaman.
The baby is reportedly the result of the teenager being raped by her 20-year-old boyfriend last year.
The baby was reportedly found with a stab wound, which in addition to witness testimony, was grounds for the teenager to be charged, according to the AGC.
The AGC said information about the rape only surfaced after the teenager was detained, prompting a probe.
The chambers also assured that the 15-year-old was going through the justice system transparently and without any influence.
The teenager was charged for the murder of her baby on Feb 9.
She was denied bail.
The Malaysian Medical Association (MMA) decried the charges against her, saying she was becoming a victim of injustice after already being a rape victim. - Mkini
