AG sure to chop 'NFA' on Soi Lek's unnatural sex charges?

Home Minister Hishammuddin Hussein may be trying to show how impartial his ministry is, but most Malaysians are betting that MCA president Chua Soi Lek will get off the hook even though there is hard evidence in the form of a DVD showing him in the act of performing unnatural sex.

“For Mr Chua, we are very sure the AG will stamp NFA (no further action) on the file. He will say things like, where is the girl, the girl cannot be found. And the next thing the AG will also say is that the DVD is not the original tape, and as such, cannot be used in court even though Chua himself has admitted is him. It is all just a show," an MCA pundit told Malaysia Chronicle.

"Don't believe? Look at the former Immigration director-general. The AG chambers was so sloppy they let the DG get acquitted despite the fact hundreds of thousands of ringgit in cash was found at the DG's home. So anything can happen." .

Gutter politics

The 63-year old Chua was forced to resign as Health minister and Labis MP after he admitted being the man featured in a secretly-recorded DVD showing him having sex with his mistress. He has accused his enemies within the MCA of plotting his downfall.

Police began investigating him under Section 292 of the Penal Code for possession and distribution of the tape as well as under Section 377A for carnal intercourse against the order of nature.

Section 377(A) states that “Any person who has sexual connection with another person by the introduction of the penis into the anus or mouth of the other person is said to commit carnal intercourse against the order of nature.” The punishment is imprisonment for up to 20 years, as well as whipping, upon conviction.

Section 292(a) states that “Whoever – sells, lets to hire, distributes, publicly exhibits or in any manner puts into circulation, or for purposes of sale, hire, distribution, public exhibition or circulation make, produces or has in possession any obscene book, pamphlet, paper, drawing, painting representation or figure or any other obscene object whatsoever; or (b)… … shall be punished with imprisonment for a term which may extent to three years, or with fine, or with both.” Those found guilty shall be punished with jail term of up to three years and/or fine.

“Soi Lek will always be haunted by this case until and unless the authorities stop exploiting privacy and sexuality as political weapons,” Batu MP Tian Chua told Malaysia Chronicle.

Brazen double standards and abuse of power

Apart from Soi Lek, Opposition Leader Anwar Ibrahim too has been a victim of Malaysia’s archaic laws. Anwar was thrown into jail in 1998 on manifestly fabricated sodomy charges by former premier Mahathir Mohamad to curb his growing political power. Anwar was acquitted and released only in 2004 after Mahathir retired.

In 2008, after announcing his parliamentary comeback, fresh sodomy charges were raised against him, which he has again denied. Anwar accused Prime Minister Najib Razak and his wife Rosmah Mansor of plotting the latest charges to derail his political career.

International support for Anwar has grown and the last global figure to call on the Najib administration to drop the charges is Richard Branson, the Virgin Airlines boss.

“These are the faults in the Malaysian system where the ruling elite abuse their power and this is the main reason why investors stay away from Malaysia because they cannot depend on the rule of law here," said Tian.

"In Anwar’s case, the evidence is so flimsy lawmakers from Australia to Canada, UK and US, have slammed Najib. But in the Soi Lek case, he was captured on film and he has admitted to it. But in true Malaysian fashion, chances are Soi Lek will escape while Anwar will be locked up.”

Meanwhile, Chinese media reported that unknown people were again distributing the DVD in Johor towns, although it can be easily downloaded for free on the Internet.

Earlier this week, in a written reply to a question raised by Petaling Jaya Selatan MP Hee Loy Sian, Hishammuddin had told Parliament that Soi Lek's case was being investigated under Section 292/509 of the Penal Code.

Hishammuddin, who is also Najib's cousin, said the Investigation Papers would be sent to the Attorney-General soon.
