An interesting statistic as to the position of remand prisoners in the United Kingdom may be of some relevance.

In Civil Liberties, Cases and Materials by Bailey Harris and Jones at page 88 Paragraph 3 the writer has outlined a very interesting piece of statistic.

“The Royal Commission on Criminal Procedure found that about 75 per cent of suspects were dealt with within six hours and about 95 per cent within 24 hours. A survey done by the Metropolitan Police for three months in 1979 showed that only 0.4 per cent of 48, 343 persons had been held for over 72 hours without charge or release”

But in Malay-sia the statistics are in the direct reverse order. In the 20 years of P. Uthayakumar being a lawyer, the police arrogance, attitude and gross abuse of powers has not changed. The Polis Raja Di Malay-sia mindset prevails right up to this date as was evidenced this morning when one Chief Inspector and Investigating Officer Halijah angrily remarked that she will get another remand order when Magistrate Wan Litifah gave four days remand when she had wanted 7 days. In fact the Magistrate told P. Uthayakumar that she would be “pulled up” if she did not give in to the police remand order. Independence of the Malay-sian Judiciary?

This morning P. Uthayakumar received an SOS phone call and attended the P.J Magistrates Court. Das, Saravanan Devan, P. Sara, Siva, Micheal & Arun were also arrested for allegedly stealing shoes from their factory.

On another case the investigating Officer Police Inspector goes to a factory and simply pulled up 8 Indian youths who looked like suspects to him. In the eyes of these Malay Muslim policemen most Indians took like suspects to them and arbitrarily arrest hundreds nationwide every day. Not having the money for bail or lawyers fees and denied the racist UMNO government legal aid and no support from their poor families these youths are forced to plead guilty out of no choice irrespective of whether they are guilty or not.

P. Uthayakumar submitted to the Magistrate that there were no and in fact zero records in the pieces of paper but what is supposed to be a Police Diary under Section 119 of the Criminal Procedure Code (C.P.C) to show what investigations were done despite being over 24 hours since they had been arrested. And that the police has no regard no respect for the fifth highest law of Malaysia as per Article 5 of the Federal Constitution which guarantees freedom of the person.

To add insult to injury the USJ Subang Jaya police OCPD dispatched a colonial era obsolete Sargeant Danial Mohamad to attend court to apply for remand. To us the Subang Jaya OCPD is insulting the Courts.

All the above only proves how the grossly inefficient racist Malay-sian police force take the Courts for granted. And the 98% Malay Muslims dominated and racist Malay-sian Court Magistrates just grant days and days of Remand jail sentences like a biscuit factory production at record speed hearings especially when the detainees and police abuse victims are the Indian poor.
