Court delays leave application hearing of EO trio

The High Court postpones hearing to Oct 5 to allow time for submissions on objections raised by AG's chambers

SHAH ALAM: Judicial Commissioner Ahmad Zaki Husin adjourned a leave application hearing of three youths detained under Emergency Ordinance 1969 at the Shah Alam High Court today.

The adjournment was made to allow submissions of affidavits on objections raised the Attorney General’s chambers and the hearing will now be heard on Oct 5.

The appellant’s were represented by Syahredzan Johan, Daniel Albert, Azira Aziz and Sara Sasha Abu Bakar.

Muhamad Arif Abu Samah, 19, Mohamed Ramadan Mohamed Ali, 22, and Mohamed Rafe Mohamed Ali, 20, were arrested on March 8, 2011 for alleged motorcycle thefts in Selayang.

Arif was banished to Mersing, Johor, Ramadan to Jengka, Pahang and Rafe to Alor Star, Kedah after being served with detention orders under the EO on March 18, 2011.

The respondents, IGP Ismail Omar, deputy home minister Abu Seman Yusop, Prime Minister Najib Tun Razak and the government, were represented by senior federal counsel Noor Hisham Ismail of the Attorney General’s Chambers.

The trio is seeking to quash the restriction order as well as compel the Prime Minister and the Cabinet to advise the Yang di-Pertuan Agong to revoke the 1969 Emergency Proclamation and the EO.

Speaking to the press after the adjournment, defence counsel Daniel Albert said: “The AG’s Chambers raised objections to our application to repeal the EO.

“However there was no objection to our application to allow our clients to return home for the Hari Raya Aidilfitri holidays.”

He added that Ahmad Zaki had advised them to negotiate with the district OCPDs to enable the trio to return home for holidays.
