The sole policeman responsible for firing the tear gas into Tung Shin Hospital compound during an illegal assembly in the capital on July 9 has been identified, but no further action will be taken against him.
According to City police CID chief Ku Chin Wah, a police report was lodged against him and investigations have been held. “The matter has been referred to the Attorney General's chambers and no further action could be taken against him due to the absence of witnesses,” the Star quoted Ku as saying.
However, Ku said disciplinary action against the policeman for breaching the standard operating procedures or SOP in dispersing the crowd would be taken.
On Tuesday, a Health Ministry probe confirmed that police had acted unethically and breached the SOP when dispersing Bersih 2.0 demonstrators at the hospital. In the ministry's report, it was stated that police had fired water cannons at demonstrators who converged at the hospital's main gate and multi-storey car park.
Home Ministry secretary-general Mahmood Adam said in the statement that the policeman involved would be referred to the police disciplinary committee.
Meanwhile, Home Minister Hishammuddin Hussein and Inspector-General of Police Ismail Omar confirmed that internal disciplinary action would be taken against officer in 'due time'.
However, Hiisham added that the incident had been blown out of proportion as the police were not solely responsible for situation during the rally for electoral reforms. According to the Home Minister, the Tung Shin Hospital incident was only "one out of six or seven" mishaps.
"On Tung Shin, there is a spin that it is looking as though the SOP of the police is at fault. This is just one incident, and the action will be taken,” Hishammuddin told reporters at Parliament House lobby.
“The fact that they are just looking at one particular incident, relating to internal disciplinary action based on SOP, to me, is like making a big mountain of a molehill.”
